COMMISSION PROCEDURE
For a commission request, please send an e-mail to lofilit@gmail.com with all the necessary details.
1. After I receive your request, I will reach out to you to discuss open questions and send you an estimation of the price.*
2. When the details are finalized and mutually agreed upon, I ask you to send the money (Euro €) for your commission. Note, that at this juncture, the option for a refund will no longer be available.
3. I will notify you when I start working on your commission.
4. I will keep you in the loop, providing updates and opportunities for your input and feedback.

TERMS & CONDITIONS
Julia Steinberg (Lofilit)
1. ACCEPTANCE OF TERMS
1.1 These Terms & Conditions of Service (Terms) constitute a legally binding agreement between Julia Steinberg’s alias Lofilit (“Artist”, “I”, “me”) and the client (“you”).
1.2 By engaging in my services, you agree to be bound by these Terms and confirm that you are at least 18 years of age. If you do not agree to these Terms, please refrain from commissioning artwork from me.
2. GENERAL TERMS
2.1 I reserve the right to decline any request if I believe that I cannot confidently fulfill it, if I am uncomfortable with the subject, or for any other reason.
2.2 Prices are based on the complexity and specifics of your request. Additional details can be included for an additional fee.
2.3 If you intend to use the commissioned work for commercial purposes, please refer to point 8.5 for relevant information.
2.4 Neither clients nor non-clients are permitted, at any time, present or future, to utilize my artwork in any NFT, or crypto, or blockchain-related processes or materials. I do not engage in such-related projects and kindly refrain from contacting me regarding such requests.
2.5 My artwork may not, under any circumstances, be utilized for AI or machine learning purposes.
2.6 Commissioned work may be showcased on my social media platforms. If you have reservations about this, communicate your preferences before commissioning me (see point 8.3).
2.7 If you intend to use the commission commercially, note that in your request, so we can discuss further details (point 8.5).
2.8 Providing references is crucial to ensuring that I accurately realize your vision. Please provide as many references and notes as necessary to convey your ideas and preferences. Providing various references for different aspects of the project (e.g., colors, theme, details, assets, pose, hairstyle, etc.) is highly encouraged and appreciated. If you would like to grant me a bit more artistic freedom, you can certainly request that as well.
2.9 In the event of a dispute, both parties agree to engage in good-faith negotiations to reach an amicable resolution.
3. CONFIDENTIALITY
3.1. Any sensitive information or reference materials shared during the commission process will be treated with the utmost confidentiality.
4. COMMISSION PROCESS AND DELIVERY
4.1 Request and Discussion: Once you submit a commission request, I will reach out to you to discuss further project details or open questions like:
- Specific requirements and details about the project like style, concept, etc.
- Project type or medium, such as illustration, 3D, 2D, rigging, animation, etc.
- File formats, dimensions, and other pertinent specifications.
4.2. Acceptance: After the details are finalized and mutually agreed upon (through emails or text messages) and we meet the legal requirement of a legally binding agreement, this written document serves as a binding contract.
4.3 Payment: Before work begins, we decided on the payment variation (please refer to point 6).
4.4 Start: After I receive the payment, you will be notified when I start working on the commission. Note, that by sending the money, the option for a refund will no longer be available (please refer to point 7).
4.5 Art process: Throughout the creative process, I will keep you in the loop, providing updates and opportunities for your input and feedback.
4.6 Delivery time: The estimated completion and delivery time will be communicated to the Client. Delays may occur due to unforeseen circumstances, but we will keep you informed.
4.7 File Formats: After the project completion, the final artwork will be delivered in the agreed-upon file formats via email or through a Google Drive link. Please download the files to your device, as the Google Drive link will only remain active temporarily. You can also provide a cloud service for the uploads yourself.
Please bear in mind that all commissions exclusively involve digital goods. Illustrations will be sent as a PNG file (unless discussed otherwise).
5. REVISIONS AND CHANGES
If there are any significant or minor changes you would like to add, please notify me as soon as possible.
With that said, please note the following:
5.1 If your request and the provided references are unclear, and lead to extensive back-and-forth communication to reach the desired result, I retain the right to charge an additional fee for the extra time.
5.2 If you wish to change something that was previously approved, I reserve the right to charge an extra fee. I will not charge fees for minor changes.
5.3 I will keep you informed of any potential additional fees resulting from your requests, ensuring transparency in the process.
6. PAYMENT
6.1 Via PayPal (or bank account for companies or larger projects). My prices are in Euro (€).
6.2 Don't send me any payment before I have agreed to work on your commission.
6.3 Payment variations:

100% upfront payment, before starting the sketch phase.

50% upfront payment, before starting the sketch phase. 50% after the sketch approval.

For larger commissions, you can pay 50% after the sketch approval. 50% after the final and approved project (send in low-resolution). Full payment must be received before the final artwork is delivered.

For companies and/or larger projects, we can negotiate the payment terms.
7. CANCELLATION & REFUNDS
7.1 You may cancel your order, free of charge, before work has commenced.
7.2 Refunds are generally not provided once work has commenced. In cases where the artist is unable to complete one or multiple items, a refund of the specific item or items will be issued.
8. COPYRIGHT & RIGHTS OF USE
All works created by me, Julia Steinberg alias Lofilit (the artist), are protected under German copyright law. This means:
8.1 Ownership and Copyright: Upon creating a work, the artist automatically retains copyright and ownership. The commissioned artwork remains under my full ownership and copyright unless a separate agreement is reached.
Therefore, I, the Artist, have the right to:
- Promote myself using the created artwork or artworks.
- Streaming the process on any streaming service.
- Display and post the artwork on any platform, including but not limited to websites and social media.
8.2 Rights of use: Copyright is fundamentally inalienable; only the rights of use of the work are negotiable.
8.3 Privacy Concerns: If you wish for a personal commission to remain private and not be posted anywhere, please discuss this with me in advance. An additional fee may be applied for such requests.
8.4 Client’s Rights: The Client, upon commissioning the artwork, is granted the following rights for personal, non-commercial purposes:
- Uploading the artwork on your personal social media profiles, forums, etc., with proper credits to the Artist.
- Printing the artwork for personal use.
- If you have designed the portrayed character, creature, asset, etc., you may claim ownership of those elements, but not the artwork itself.
If you have any specific questions or concerns regarding copyright or rights of use, please do not hesitate to contact me.
8.5 Commercial Use¹ and Modifications²: Any commercial use, reproduction, or modification of the commissioned artwork requires explicit written permission from the Artist. Before starting the work of the commission, we will define the specifics of how you intend to use the artwork. Based on this discussion, we will determine any applicable fees and the scope of usage rights.
¹ Commercial use can include, but is not limited to, the use of the artwork for promotional materials, advertisements, merchandise, resale, or any other profit-generating activities.
² Modifications refer to any alterations, adaptations, or derivative works based on the commissioned artwork.
9. CHANGES TO TERMS
9.1. I reserve the right to modify these Terms at any time. You will be notified of any changes, and continued use of our services will constitute acceptance of the revised Terms.
